Draft: not in effect yet. It starts when music uploads open. Highlighted parts still need to be filled in.
Effective date: [DATE UPLOADS OPEN]
In short: you keep owning your music. You let us play it for listeners and share it from your artist page. You promise it's really yours. You get paid a share of subscription money. You can take it down any time.
This agreement is between you (the "Artist") and [YOUR LEGAL NAME OR BUSINESS NAME], doing business as Raven's Immortal Art Studios ("we", "us"). It applies every time you upload music, artwork, lyrics or other material ("Your Content") to our music platform. It is part of our Terms of Service. When you check the box at upload, you agree to it.
1. You keep ownership
You keep all ownership of Your Content. Nothing in this agreement transfers your copyright to us.
2. The permission you give us
You give us a non-exclusive, worldwide license to:
- store, copy and convert Your Content into the formats needed to stream it;
- stream it to listeners on our website and apps, including subscribers and, if you choose, free listeners;
- show your artist name, song titles, artwork, lyrics and description;
- use short clips (up to 30 seconds) and your artwork to promote your music and our platform.
"Non-exclusive" means you can still put your music anywhere else you want, including Spotify, Apple Music, BandLab, SoundCloud or your own site.
We do not get the right to sell your music as downloads, license it to films, ads or other companies, or use it to train artificial intelligence, unless you separately agree in writing.
3. Your promises
By uploading, you promise that:
- you wrote and recorded Your Content yourself, or you have written permission from everyone who did (co-writers, singers, producers, beat makers);
- it does not contain anyone else's song, lyrics, melody, beat or recording, including cover songs, remixes of other artists' songs and samples, unless the sample is from a source that allows commercial use (for example, the sounds built into our studios, or a royalty-free sample pack whose license you have read);
- it does not use an AI copy of a real person's voice without that person's written permission;
- it follows our content rules;
- you have not signed a deal (with a label or distributor, for example) that stops you from giving us this license.
Made in our studios? Music you make in our Music Studio or Film Score Studio is yours. The built-in sounds and orchestra recordings are free to use in your songs, including songs you earn money from.
4. Covers and famous songs are not allowed (for now)
We do not currently hold the licenses needed to stream cover songs or recordings owned by record labels. Uploads that contain them will be removed. We may allow covers in the future once those licenses are in place.
5. Getting paid
- Each month, [X]% of subscription money (after payment processing fees and taxes) goes into the artist pool.
- The pool is split between artists based on how many times subscribers fully played their songs (a "play" means at least 30 seconds of listening).
- Your earnings are shown on your artist dashboard. We pay by PayPal once your balance reaches [$ MINIMUM]. Payments are made within [30] days after the end of each month.
- Plays from fake accounts, bots, or anyone paid to play your songs don't count. Earnings from them can be cancelled, and the account removed.
- You are responsible for any taxes on your earnings. We may ask for tax forms before paying you.
- If a song has more than one owner, you are responsible for sharing your earnings with them as you agreed.
6. Taking your music down
You can delete any song at any time. It will stop playing on our platform within 24 hours. Copies in our backups are deleted within 30 days. Money you earned before deleting it is still yours.
7. If someone says your song is theirs
If we get a valid copyright complaint about your song, we will remove it and tell you, as described on our Copyright & Takedowns page. You can send a counter-notice if you believe it was a mistake. Earnings for a disputed song may be held until the dispute is settled.
If you break the promises in section 3, you agree to cover the costs we face because of it (for example, legal costs from a claim about your song).
8. Young artists
You must be at least 13 to upload. If you are under 18, a parent or guardian must agree to this agreement for you and receive any payments for you.
9. Changes
If we change this agreement, we will tell you by email or on your dashboard at least 30 days before the change starts. If you don't agree with a change, you can remove your music before it starts.
